1. Introduction

Welcome to Onlive Infotech. By accessing, using, or purchasing any of our services (including USB-Based Server Hosting, VPS, Dedicated Servers, Cloud Hosting, Shared Hosting, Domain Registration, or other related services), you agree to comply with and be bound by these Terms & Conditions (“Terms”).

If you do not agree to these Terms, please do not use our website or services.

2. Definitions

  • Service: Any hosting, USB-based server, domain registration, or related service provided by Onlive Infotech.
  • Customer / Client / You: The individual or legal entity that purchases or uses our Services.
  • Account: The customer account created to access, manage, and use the Services.

3. Eligibility & Account Information

  • You confirm that you are at least 18 years of age and legally capable of entering into a binding agreement.
  • You agree to provide accurate, current, and complete information, including valid contact and billing details, during registration.
  • You are responsible for keeping your account information updated at all times.

4. Use of Services — Acceptable Use Policy

  • You agree to use our Services only for lawful purposes and in compliance with all applicable local, national, and international laws.
  • You must not use the Services to:
    • Host or distribute illegal content
    • Infringe intellectual property rights
    • Send spam or unsolicited communications
    • Distribute malware, viruses, or engage in hacking activities
    • Conduct abusive, fraudulent, or harmful behavior
  • You are solely responsible for all content, data, and activities conducted through your account.

5. Payment, Renewal & Billing

  • Services are billed according to the pricing and plan selected at the time of purchase.
  • All services are subject to automatic renewal unless cancelled before the renewal date.
  • In the event of failed payments, chargebacks, or overdue invoices, Onlive Infotech reserves the right to suspend or terminate services without prior notice.

6. Service Availability & SLA

  • While we strive to maintain high service availability, Onlive Infotech does not guarantee uninterrupted service unless explicitly stated in a separate Service Level Agreement (SLA).
  • Our SLA defines uptime commitments, support response times, and applicable service credits, if any, in case of service failures.

7. Intellectual Property & Content

  • You retain full ownership of all data and content hosted or uploaded on our servers (“Customer Content”).
  • Onlive Infotech retains all rights, title, and interest in its infrastructure, USB server hardware, systems, software, and proprietary technologies.
  • You grant Onlive Infotech a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Services.

8. Limitation of Liability

  • Onlive Infotech shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, revenue, profits, or business interruption.
  • Our total liability, if any, shall not exceed the amount paid by you for the affected service period, subject to the limits defined in the SLA.

9. Termination

  • Either party may terminate the Services in accordance with the applicable service plan and billing terms.
  • Upon termination, you are responsible for backing up and removing your data. Onlive Infotech may delete data after a reasonable grace period unless legally required to retain it.
  • We reserve the right to immediately suspend or terminate Services if you violate these Terms, misuse the Services, or engage in prohibited activities.

10. Changes to Terms

  • Onlive Infotech reserves the right to update or modify these Terms & Conditions at any time.
  • Changes will be communicated via email, website notice, or customer dashboard.
  • Continued use of the Services after changes indicates acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

  • These Terms shall be governed by and interpreted in accordance with the laws of India.
  • Any disputes shall be subject to arbitration or courts of competent jurisdiction in India, as applicable under Indian law.
